Adventure Hunters
Effective Date: 1 January 2025
Welcome to Adventure Hunters. These Terms of Service ("Terms") govern your access to and use of our services. By engaging with any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Our Services
Adventure Hunters provides the following services:

Software Services**: We develop and provide custom or off-the-shelf software solutions.

MTB (Mountain Bike) Coaching**: Professional coaching sessions for mountain biking.

Wooden Ladder Construction**: Design, build, and supply of custom wooden ladders.
Additional services may be added from time to time and will be subject to these Terms.
Payments and Billing

Software: Full payment is required before we release or deliver any software.

MTB Coaching: Full payment for each session is due before you arrive for the session.

Wooden Ladders: Full payment is due upon delivery of the completed ladders.
All prices are quoted in South African Rand (ZAR) unless otherwise stated. We accept the payment methods communicated at the time of booking or ordering. No refunds will be issued after payment unless explicitly agreed in writing by us.
Health and Safety – MTB Coaching
For your safety and the safety of others, we reserve the right to refuse or cancel any MTB coaching session if we reasonably suspect that you are not physically or medically fit to participate. This includes visible signs of illness, injury, intoxication, or any condition that could endanger yourself or others. No refund will be given in such cases. You must disclose any relevant medical conditions prior to booking.
MTB Coaching Waiver and Release of Liability
By booking, paying for, and participating in any MTB coaching session provided by Adventure Hunters, you expressly agree to the following waiver and release:
Assumption of Risk
I acknowledge and understand that mountain biking and MTB coaching involve **inherent and significant risks** of serious injury, permanent disability, paralysis, or death. These risks include, but are not limited to: falls, collisions, equipment failure, uneven terrain, weather conditions, fatigue, and the negligence of other participants or third parties.
I voluntarily assume **all risks**, known and unknown, and agree that my participation is entirely at my own risk.
Release of Liability
I hereby release, indemnify, and hold harmless Adventure Hunters, its owners, directors, employees, coaches, contractors, agents, and affiliates (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of my participation in MTB coaching sessions.
This release applies even if the loss, damage, injury, or death is caused in whole or in part by the negligence of the Released Parties, except in cases of gross negligence or wilful misconduct.
Fitness and Medical Consent
I confirm that I am in good physical health and have no medical conditions that would prevent me from safely participating. I authorise Adventure Hunters and its coaches to seek emergency medical treatment for me if required, and I agree to be responsible for all associated costs.
No Refunds for Waived Sessions
If a session is cancelled by us due to health/safety concerns, no refund will be issued.
This Waiver and Release is binding on me, my heirs, executors, administrators, and assigns.
General Use of Services at Your Own Risk
All services provided by Adventure Hunters are used **entirely at your own risk**.
- Wooden ladders are provided for your use; proper installation, maintenance, and safe usage are your responsibility.
- Software is provided "as is" and you are responsible for testing, implementing, and backing up your data.
Adventure Hunters, its owners, employees, contractors, and agents shall not be liable for any injury, damage, loss, or claim arising from your use of our services, except where caused by our gross negligence or wilful misconduct.
Intellectual Property and Software
All software, designs, documentation, and materials provided remain the intellectual property of Adventure Hunters until full payment is received. Upon full payment, you receive a limited, non-exclusive, non-transferable licence to use the software for its intended purpose. You may not copy, modify, reverse engineer, or distribute the software without our prior written consent.
Data Protection and POPIA Compliance
We are fully committed to protecting your personal information and comply with the Protection of Personal Information Act (POPIA). We implement reasonable technical and organisational measures to safeguard your data.
By using our services, you consent to the collection, processing, and storage of your personal information for the purposes of providing the services, billing, and legitimate business interests. Warranties and Disclaimers
All services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Adventure Hunters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount actually paid by you for the specific service giving rise to the claim.
Termination
We may terminate or suspend your access to our services immediately if you breach these Terms, fail to make payment, or engage in conduct that we reasonably believe is harmful.
Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes. Your continued use of our services after such changes constitutes acceptance of the new Terms.
